Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the website at kiyulabs.com (the "Site"), operated by Kiyu Labs, a partnership of M.K Lieng & A.Y Su (ABN 88 438 580 536) ("Kiyu Labs", "we", "us"). By accessing or using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. About this Site

The Site is an informational and marketing website describing our products, automation and consulting services and inviting enquiries. It does not create a client relationship on its own. Any engagement to provide services is governed by a separate written agreement between you and Kiyu Labs.

2. No professional advice

Content on the Site is provided for general information only. It is not professional, technical, financial or legal advice, and you should not rely on it as a substitute for advice tailored to your circumstances. Case studies and results describe past projects and are not a guarantee of any particular outcome.

3. AI and automation outputs

We build AI and automation solutions. Outputs generated by AI systems can be inaccurate, incomplete or unsuitable for a particular purpose, and any examples on the Site are illustrative only. We do not warrant any specific result, performance or return from our services, and you remain responsible for independently reviewing any output before relying on it. The terms of any actual project (including scope, deliverables and how AI is used) are set out in a separate written agreement.

4. Enquiries and bookings

When you submit the enquiry form or book a call, you agree to provide accurate information and not to impersonate any person or organisation. Submitting an enquiry or booking a consultation does not oblige either party to enter into a paid engagement. Bookings are handled through our third-party scheduling provider (see the Privacy Policy).

5. Acceptable use

You agree not to:

  • use the Site in breach of any law or regulation;
  • attempt to gain unauthorised access to, interfere with, or disrupt the Site or its underlying systems;
  • introduce malicious code, or scrape or harvest data other than as permitted by us in writing;
  • submit content that is false, misleading, infringing, defamatory or otherwise unlawful.

6. Intellectual property

Unless otherwise stated, all content on the Site (including text, graphics, the Kiyu Labs name and logo, layout and code) is owned by or licensed to Kiyu Labs and is protected by intellectual property laws. You may view and print pages for your own reference, but you may not reproduce, republish or exploit any part of the Site commercially without our prior written consent. Third-party names and marks (for example, clients referenced in case studies) remain the property of their respective owners.

7. Third-party links and services

The Site links to and embeds third-party services (such as our scheduling and form providers). We are not responsible for the content, practices or availability of third-party services, and your use of them is subject to their own terms.

8. Disclaimers and liability

The Site is provided "as is" and "as available". To the maximum extent permitted by law, we exclude all warranties not expressly set out in these Terms and are not liable for any indirect or consequential loss arising from your use of the Site. Where our liability cannot be excluded but can be limited, it is limited to re-supplying the relevant information or service. Nothing in these Terms limits any rights you have under applicable consumer protection law (for example, the Australian Consumer Law) that cannot lawfully be excluded.

9. Indemnity

You agree to indemnify Kiyu Labs against any claim, loss or cost arising from your misuse of the Site, your breach of these Terms, or your infringement of any law or third-party right.

10. Dispute resolution

If a dispute arises in connection with the Site or these Terms, the parties will first try to resolve it in good faith by discussion. If it is not resolved within a reasonable time, the parties will attempt mediation in New South Wales before starting court proceedings, except where urgent injunctive relief is needed.

11. Changes

We may update these Terms from time to time. The current version will always be posted on this page with its "last updated" date. Continued use of the Site after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that place.

13. Severance

If any provision of these Terms is found to be invalid or unenforceable, it is severed to the minimum extent necessary and the remaining provisions continue in full force.
